Yes ... as long as there is a properly sized overcurrent device at the supply of the circuit, and that practice is quite common too.
The overcurrent protection for the circuit conductors would be at the supply end of that circuit (at the panel the circuit originates from), all that disconnect would be doing is providing a means for the contractor to remove power to the a/c unit for servicing and not have to worry about someone restoring power to the circuit while they are working on the circuit or equipment.
